Tycoon Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out what you may not do with Tycoon: AI Store Agent, its dashboards, its APIs and the demos on tycoonagent.ai and demo.tycoonagent.ai. It forms part of the Merchant Terms of Service between you and GIXODIA L.L.C-FZ ("GIXODIA", "we"). Tycoon Agent is a brand of GIXODIA L.L.C-FZ. It also applies to anyone who uses a Demo.

1. Definitions#

Capitalised terms have the meanings in the Terms. "You" means the Merchant and anyone using the Service or a Demo through or for it.

2. Prohibited products and stores#

You must not use the Service for a store or offering that:

1. sells goods or services that are illegal where they are sold or delivered, or that Shopify's Acceptable Use Policy prohibits, including weapons and weapon parts where restricted, illegal drugs and drug paraphernalia, counterfeit or stolen goods, and items that infringe intellectual property;
2. sells tobacco, nicotine and vaping products, alcohol, cannabis or hemp-derived products, gambling services, or other age-restricted products, unless your store has effective age-verification and sales controls that the law of your markets requires, and you configure the Agent not to promote those products to anyone who may be under the legal age;
3. sells adult sexual content or services; or
4. offers regulated financial, investment, credit, insurance, legal or medical services, or prescription medicines.

3. Prohibited claims and content#

You must not configure, instruct or allow the Agent (through Approved Facts, playbooks, rules, corrections or any other Merchant Content) to:

1. make false, misleading or unsubstantiated claims, including about price, discounts, origin, materials, certifications, reviews, popularity, scarcity or urgency;
2. make medical or health claims, such as that a product diagnoses, treats, cures, mitigates or prevents a disease or condition, or replaces medical advice, or any claim that the law of your markets treats as a medical claim;
3. make environmental, safety or performance claims you cannot substantiate;
4. state prices, stock, delivery dates or discount codes other than through your live store data, Approved Facts and Owner Rules;
5. generate or spread content that is unlawful, defamatory, hateful, harassing, sexually explicit, violent or discriminatory, or that infringes anyone's rights;
6. present fake reviews, fake testimonials or false purchase notifications; or
7. deny being an AI, impersonate a real person, or hide or remove the AI notice or the option to reach a human.

4. Protecting Shoppers#

You must not use the Service to:

1. target, profile or market to children, or knowingly collect personal data from children under the age that requires parental consent where you sell;
2. collect payment card data, passwords, government identification numbers, health, biometric or other sensitive data through the chat;
3. profile Shoppers based on sensitive characteristics, or make decisions that have legal or similarly significant effects on them;
4. add paid items to a cart without the Shopper's request or confirmation, or exploit a Shopper's vulnerability, distress or hesitation;
5. send unsolicited marketing to Shoppers, or use contact details left through the Agent for purposes the Shopper was not told about; or
6. record, analyse or use conversations in breach of privacy, wiretap or consumer laws.

5. Protecting the Service#

You must not, and must not help anyone to:

1. try to jailbreak the Agent or inject instructions (prompt injection) to make it ignore its rules or guards, reveal its system instructions, prompts or guard logic, produce prohibited content, or expose another store's data;
2. reverse engineer, decompile or disassemble the Service, or try to extract its source code, prompts, models or weights, except where the law expressly allows it despite this restriction;
3. probe, scan or test the vulnerability of the Service or bypass authentication, rate limits, Economy Mode, usage caps or bot protection, except under a written security-testing agreement with us;
4. overload the Service, including with automated, bulk or artificially generated traffic, or run load tests against it;
5. scrape, crawl or harvest data from the Service, the dashboards, the Demo or tycoonagent.ai, or use automated tools to create demos or sessions;
6. request a personal Demo for a store you do not own or manage, or enter other people's personal data into a Demo;
7. use the Service or its output to build, benchmark or train a competing product or AI model;
8. share your login, resell access, or use one plan for stores it does not cover; or
9. introduce malware or interfere with other merchants, Shopify or our providers.

6. Provider policies#

The usage policies of our AI providers (currently Anthropic and, if switched on, Google) and Shopify's Acceptable Use Policy also apply to your use of the Service. Where a provider or Shopify requires it, we may restrict a store or a request even if this AUP does not expressly cover it.

7. Reporting#

Report suspected misuse, illegal content, security vulnerabilities or harmful AI Output to tycoonagent6@gmail.com. Please include the store, the date and time and, for chats, the conversation ID. We do not take action against good-faith security researchers who report a vulnerability to us promptly, do not access data beyond what is needed to show the issue, and do not disrupt the Service.

8. Enforcement#

8.1 What we may do. If we reasonably believe that this AUP has been breached, we may, in proportion to the breach: ask you to fix it; remove or disable specific Merchant Content, Approved Facts or playbooks; switch off a feature; pause the Agent on your storefront; end a Demo; block traffic; suspend your account; or terminate the Terms under Section 17 of the Terms.

8.2 Notice. We will usually tell you first and give you a reasonable opportunity to fix the problem. We may act immediately where there is a risk of harm to Shoppers, to the Service or to others, where the law or Shopify requires it, or for repeated breaches. We will tell you the reasons for any restriction unless the law prevents us.

8.3 Review. You may ask us to review a decision by writing to tycoonagent6@gmail.com. We will reply within a reasonable time and restore the Service where the reason no longer applies.

8.4 Authorities. We may report illegal activity to the competent authorities and to Shopify, and cooperate with them, as the law allows or requires.

8.5 No duty to monitor. We are not obliged to monitor your store or conversations, and our not acting on a breach is not a waiver.

9. Changes#

We may update this AUP. Material changes take effect after at least 30 days' notice under Section 22 of the Terms, except changes required sooner by law, by Shopify or by our providers, or needed to stop abuse.
